How Do I Get a Labor License? Is It Only for Contract or Permanent Workers?

Please advise on the process for obtaining a labor license from the Labor Department. Is it applicable only to contract labor or permanent labor?

It is applicable to both contract labor and permanent labor. It is mandatory to obtain licenses at any level of labor. Please fill out Form 1, submit it to the local labor office, and acquire the labor license.

Dear Pulkit,

Steps:

1. First, apply for Certificate of the Principal Employer (i.e., Form V in West Bengal) to the Principal Employer under which your company is working along with duly filled Form IV and Trade license (if applicable in your case).

2. After getting Form V, you may directly approach the Licensing Office for obtaining a labor license with the following documents:
a) Form V (Certificate of the Principal Employer)
b) Form IV (Application for Labor License)
c) Work Order Copy (only the documents where the duration of the Contract is mentioned)
d) Original Copy of Treasury Challans (as Proof of submitting the amount under Contract Labour Act & Rules, as per central or state regulations)

The Licensing Officer will review your application along with the mentioned documents for the preparation of the Labor License. Within 15 days, you will receive the labor license.
