How Can I Withdraw My PF Without Tax After Switching to a Non-PF Deducting Employer?

bramalingam81
I have been contributing to EPF for 4 years and 8 months through an employer. Now that I switched my job to another employer who does not deduct any PF, as the employer can decide not to deduct PF if the basic salaries of all the employees are more than Rs 6500. I thought of transferring my PF from the previous employer to the current employer so that my PF account would have been more than 5 years, but came to know that my new employer does not deduct PF only after joining. 

I have been going through various posts which say that a PF account with continuous contributions of 5 years and above will not incur any tax during withdrawal. Can someone help me out with suitable steps to withdraw my PF from my previous employer without incurring any tax?

Thanks,
Balaji

Dear Sreekanth, please search for the topic "198133-pf-pension-amount-premature-withdrawal." I see that TDS is deducted by the PF Office. If the new company is not deducting PF, it's not the employee's fault. Can we substantiate it and get the TDS refunded?

Thanks,
Balaji

In case you have been contributing to PF with your earlier employer and are still working with another employer who is also covered under the Act, you are verily entitled and liable for provident fund benefits. Wait for the time; sooner or later, if it is realized by the PF Enforcement Officers or Assistant Commissioner, your entire contribution together with the employer's share shall be recovered from your employer.

From your point of view, you could address a letter to the present employer clarifying that you have been a member of the fund in earlier employment, cite your PF number, and mark a cc of the letter to the Assistant PF Commissioner (Compliance) of the respective Regional/Sub-Regional EPFO from where your present employer is covered.

Thanks and regards,
