Can We Get a Factory License for a Rented Space Without Building Plan Approval?

We have a new factory on rent. Can anybody suggest if we can get a factory license for this factory directly without the approval of the building plan? Or is the building plan approval necessary in this case? Kindly advise me.

If your nature of business is different from the business that was carried out earlier in the factory you have rented, you have to submit a fresh plan giving details of the machinery layout, factory dimensions, etc. Based on the plan, the factory's inspector will approve the plan. If you are continuing the same business, then you need to revalidate the plan by changing the occupier's name, etc., and seek a license.

The building plans are necessary, as the act provides that the place should meet safety aspects (one of the most important aspects being whether emergency exits have been provided or not) or if there is a mezzanine floor, what is the height, etc. You will also have to submit the stability certificate for that building. In the absence of these, one may incur heavy penalties.

Mr. Khannan is right. I have a question. On the building plan, is the fee cess charged necessary to pay for rented premises? The first party has already paid it.

If you are going to carry out the same business with the same structure and also if the previous employer had a building plan, you can just go for a name change, and then you can apply for your factory license.

Sir, they were not running any business or paying any cess. Now, we want to pay cess. My question is, for CESS assessment, do we need to register under the BOC Act for the building that was constructed in 2006 with no construction till now?

We have rented another factory for manufacturing the same product that we have in our existing factory. The question is, what do we need to do as far as the Factory Act is concerned? The factory owner (landlord) has a license for the manufacturing until Dec-15.

I have taken a factory on rent that was closed earlier (no production is done). I want to change the name of the factory, but there is an issue regarding the change in name due to the industrial area of the government. Please guide me on how I can change the name of the factory.
