Is the Employment Exchange Act Relevant for Small Private Companies Like Ours?

hrm_ns@gsfcltd.com
Dear All, I am working in a private limited company, and the total employee strength is 15 people. Recently, a job advertisement for permanent positions was released in the local newspaper, and I received a letter from the Employment Exchange to inform them about the vacancies before the advertisement.

Understanding the Employment Exchange Act

As per my understanding, the Employment Exchange Act is applicable to government/semi-government organizations only, not to private limited companies. Kindly correct me if the Employment Exchange Act could be applicable to our company as well.

Even I am here with the same question. Please, someone, let me know, can Pvt Ltd companies make use of employment exchange services? If so, what are all the formalities?

Please, seniors, advise...

Applicability of the Employment Exchange Act

This act is applicable to any organization (Private, Semi-Government, or Government) with a manpower of 15 or more, or if the job is for less than 3 months in duration. The following jobs are, however, excluded:

• Jobs at Parliament
• Domestic work
• Duration of work/job is less than 3 months
• Unskilled office work

The returns (ER 1 & ER 2) should be filed with the local Employment Exchange, and notification of vacancies should be given at least 15 days prior to conducting a written test or interview.
