Are ESI provisions applicable to the insurance industry? Is there any circular or judgment related to this?

In my understanding, there is no special exemption given to the insurance industry as a whole. However, if your establishment provides better medical and other facilities to your employees and their family members than what is offered under the ESI schemes, you may be eligible for an exemption from ESI. To achieve this, you must apply and demonstrate to their satisfaction that the benefits to employees are more advantageous than those provided by ESI.

ESI Act and the Insurance Industry

Prior to 2009, the ESI Act was not applicable to the insurance industry. There was a judgment in 2009 that brought about some changes. I am unsure about the specifics, which is why I require inputs from my HR friends.

I don't have the details with me, but I have seen a letter from the ESI department regarding a survey of all the insurance companies, including LIC and others. This letter was supported by another from the Central Government. So, it's beyond doubt that insurance companies, being in the service sector, would be covered under the ESI Act if they have the requisite manpower and fulfill other criteria.
