About Gratuity - Esic Consultant

Dear All,
i am working in pvt company as a accountant. My esic consultant told me about gratuity is applicable to company when the company is register in factory a/c. my company is start in may-2005. company not availed factory a/c so my company is eligible to pay gratuity to not eligible to pay gratuity & esic start to my company in 2009. so please tell me my company is applicable or not applicable to pay gratuity

It is not confined only to factories but it applies to establishments employing not less than 10 persons. Therefore, if yours is an establishment coming under the Shops and Commercial Establishment and employing ten or more employees, then the Payment of Gratuity Act will be applicable to you.
