Launching a Web Portal: Does the Shop and Establishment Act Apply Without Employees?

Is the Shop and Establishment Act applicable when there are no employees? What should be the number of employees for the provisions of the act to apply? I want to launch a web portal. For managing the portal, I would be outsourcing the work to other agencies who would work either at their own place or may work at my place for a brief period. I may choose to have one or two employees. Please guide.

For 1 to 5 employees, the challan for Shop & Establishment is Rs. 300/-; if you show 1 employee or 5 employees, the challan will be the same.

Please let me know if the Nasik MIDC Shop and Establishment Act applies or not. Also, could you please provide information on where I can access the law (website name)?
