Can Management Refuse to Recognize a Newly Formed Trade Union of 10+ Workers?

Dear All,

If a group of 10 or more people join together and form a union, and send a letter to management stating the name of the union and other details such as the list of Office Bearers, can the management refuse to recognize the formation of the union? Or is it obligatory to recognize the union as being formed by workers? Please suggest.

There is no compulsion upon the management to recognize a Trade Union, whether it is registered or not.

Make sure you don't reply to the letters sent by your trade union or attend meetings organized by them or meetings organized by the Labor Commissioner's office where they are called to discuss any issues such as industrial disputes.

If there is a company with 500 employees working in Faridabad and they have a workers' union, and the company starts a new plant at another location with 300 employees, the workers at the new plant may want to form a new union. Can the company allow them to form a new union? Please answer ASAP.
