Hi All
I work in a small IT company in Mumbai as Recruiter.
My salary is Rs 3lakhs / Anum. the inhand salary is 25k (fixed).
Now after 4 months and my confirmation my employer forcefully made 30% of it Variable depnding upon recruitment and if anyone resigns from my organization 1k will be deducted from my salary.
my question is can an employer change the salary structure any time ?
Is Hr executive held responsible resiganation of any employee.
If my employer fires me can I sue him and ask for 2 Months salary.
please let me know

The policy of your management is illogic. Salary can be variable but it should be decided and informed beforehand. It is illegal to change the salary structure without informing the employee. It is not fair to deduct salary for reason of resignation of other employees because the reason for resignation can not be directly attributed to HR Executive's attitude but it may be due to other reasons including the attitude of the company management. However, it is baseless to fight against such an employer; better find some other place to work.

Hello Nilson,
in the above post sir is suggesting very rightly, every thing is in your favour, but your position is not to fight at this stage so as to waste your energy which you can positively use to grow and follow your purposes, there are less no of such employers, better get rid of them.........
all the best,
with regards,

Thanks Madhuji and Shivendraji,
I tried to explain my employer about the measure reasons of attritions are company is a privately owned , not being a pvt. ltd. odd shift times, better opportunity and work pressure etc. but it seems in vain.
Now I have decided to except whatever he says but putting some conditions from my end as well.
I hope this will give time to search a better place to work :)
Thanks a lot again Sir for giving me guldens and helping me come out of frustration.
