Welfare Measures in Establishments

The Factories Act, Mine Act, Plantations Labour Act, or (State) Shops and Commercial Establishments Act have provisions relating to many welfare measures to be implemented in the establishments. These include setting up clean restrooms, crèches, canteens, washrooms, ambulance rooms, etc., subject to certain conditions regarding the number of employees employed and the nature of work performed. These are statutory welfare schemes that are mandatory; without them, the establishment has no right to exist.

At the same time, there are many other schemes not mentioned in these Acts, such as playgrounds, medical centers, cinema halls, cooperative stores, schools for employees' children, etc. These should be treated as non-statutory welfare schemes of the establishment.

Statutory & Non-Statutory Welfare Facilities

1. Statutory Welfare Facilities

• Sanitary and hygiene facilities
• Washing facilities
• Drinking water
• First-aid box
• Ambulance room
• Rest shelter facilities
• Feeding facilities (canteen)
• Crèches
• Medical facilities

2. Non-Statutory Welfare Facilities

• Educational facilities
• Recreation facilities
• Transport facilities
• Family planning
• Cooperative credit societies
• Consumers' cooperative stores and fair price shops
• Distress relief and cash benefits

Every factory or establishment must provide statutory facilities. Non-statutory facilities can be implemented depending upon the size and economic status of the factory or establishment. While non-statutory facilities are optional, statutory facilities must be provided.
