Are Charitable Trusts Really Exempt from PF? Seeking Guidance for Our HR Team

I am from a charitable trust looking after the HR department. We have more than 50 employees. Right now, we have not taken PF numbers. I have heard that charitable trusts can be exempted from the PF Act. Please guide me.

If you have a trust and are exempted by the EPF department, then there is no need to obtain a fresh EPF code. Otherwise, you should be aware that PF is applicable to 20 employees, and it is likely to be applicable to 10 employees. The bill for the amendment is pending. Please read the attachment as well.

Thank you for your response. My question is worded differently. Is the PF code applicable to us? The exemption is a secondary consideration. The primary query is whether the PF code is applicable to us or not. Please let me know if you need any further clarification.

I have come to know from some sources that the Supreme Court has given a judgment on this issue. Is this true? Can anybody confirm this? Please reply.

Employees' Provident Fund and the Miscellaneous Provisions Act of 1952

This is social security legislation, and employee rights, just like salaries, are protected under this act. All exemptions provided in this act are based on equal or better benefits. Therefore, as a charitable trust, you cannot deny the rights of the employees.
