Employees Compensation Act, 2010

The Employees Compensation Act, 2010 was a long-awaited step after independence, especially after 1958 when substantial industrialization began to pick up pace. Although it was inordinately delayed by substituting the word "employee" for "workman," the dynamic nature of labor law is recognized. The class of employees doing clerical work or whose nature of work is interpreted as clerical will now benefit. The Act has widened its scope.

Clarification on Employee Compensation Act

Please clarify the following doubts regarding the Employee Compensation Act:

1. How is an employer supposed to ascertain whether an injury has occurred inside the plant or outside?
2. How is an employer supposed to ascertain the number of days for which compensation needs to be given?

These questions have been posed in the context of a situation where employees are trying to claim compensation by submitting fake complaints (such as ankle sprain, back pain, etc., which are not visible in X-Ray/MRI but difficult to disprove).
