Retirement Age in Manufacturing: What's the Maximum Limit and How Does It Affect You?

Dear all, I just want to know the maximum age of retirement in the manufacturing industry.

It is usually 58 years. It also depends on the policies and practices of the company. If it is the central government, it is 60 years. In Karnataka, the state government is also following the same criteria of 60 years of employee age; two years ago, it was 58 years.

As I know, in Silvassa, many companies do not retire old employees. Even electricians and fitters work until the age of 70. Is this legal or illegal?

The maximum age of retirement in manufacturing industries is classified into two categories: the nature of work involved is more manual, and the nature of work involved is less manual. If the nature of work involved is more manual, the retirement age is generally 58 years, and in some industries, the retirement age is only 55. However, in any case, the retirement age is based on either the standing orders of the company and/or the service conditions (Appointment Order) of the company. In other cases, it is only 58 years. Moreover, according to the definition in various labor laws, the retirement age is 58 only. Importantly, the eligibility for availing full pension under the EPF Act is 58 years.

The retirement age is 58 years as per the EPF Act. Our company is a 160-year-old German MNC, and there the retirement age is 65 years. We have adopted the same model here, and we have been given the green signal by the authorities on this.

It is normally 58 years. We also adopt the same in our organization. It is the company's discretion to have them retire at 60 years of age or 65. However, as far as PF regulations are concerned, 58 years of age is taken into consideration as the retirement age.

I am responsible for HR activities in a Food Processing Industry, where an employee retired at the age of 58 years as per our organization's terms and conditions of appointment. However, it can be extended at the will of management.

As per the labor laws, the retirement age is 58 years. However, in some companies, people continue working even after reaching their retirement age. This decision is ultimately up to the company's management.

Dear tsilbrd, Yes, it is 58, as stated in the Employee's Pension Scheme, as well as various state amendments. However, in Maharashtra, by virtue of the Standing Orders Act, the age of retirement is 60.

Secondly, there is no bar to work beyond the age of retirement by any law. If the person's health supports it, he can work up to his death too.

If the employer and employee want to continue after the retirement age, which is 58 as per the policy or appointment letter, then what is the procedure for the same.

In that case, can the employee continue in the EPF scheme? Can the employee avail of the PF/pension and continue in the service? What about ESI?

If the employee cannot continue, what are the options? Is it possible to work as a retainer?
