Confused About Probation and Confirmation: What Happens After a Year Without a Letter?

koteshy123
Dear All,

I have a question regarding confirmation. An employee joined our organization in the Manager-grade. After six months, he received his appraisal form for confirmation, and he was recommended for confirmation. Two days later, the unit head asked him to sign another appraisal form, stating that management wanted to extend his probation for three more months. Initially, he rejected the request, but later signed the form. However, after three months, he did not receive his confirmation letter. Now, he has completed one year of service. Will his services be confirmed or not? He also received an increment in the meantime.

Please clarify this issue with details.

Hi,

Kindly note the following:

1) The conditions in the appointment letter regarding this need to be read. If it says that unless the employee is informed of his/her confirmation in writing, he/she continues to be on probation, then the manager you are talking about continues to be a probationer.

2) However, the very fact that he has been continued for more than a year and having been given an increment clearly indicates that he is confirmed. The non-issuance of the confirmation letter becomes immaterial. (I also presume the probation extension letter was not issued in this case).

Can anyone tell me, after the confirmation of an employee, should the salary be raised or not?

I am writing to seek advice on whether it is appropriate to increase an employee's salary following their confirmation. Your insights on this matter would be greatly appreciated. Thank you.

Salary Hike and Confirmation

It is not mandatory to give a salary hike along with confirmation. Generally, companies align all their employees with the nearest appraisal cycle. However, if the organization is small and management is keen to retain its current employees, there is definitely nothing wrong with giving a salary increase. Just ensure that certain broad guidelines are laid down, understood, and signed off with management to ensure consistency and parity.

Thank you, Dayanand Sir!

In case, after receiving the confirmation letter, the employer has not provided any further communication at the time of implementing the raise/increment and has started paying the increased salary, is there any possibility of the Notice Period being affected? (My Notice Period is 3 months or an amount equal to the salary of 3 months, whereas the employer has stipulated just one month or an amount equivalent to one month only from their end.)

I understand the issue as follows: the salary increment has been effected, and there is no letter indicating the same. However, the consistency in the rise (to show that it was not a one-time payment) can be seen in the payslips every month. The original letter of appointment with its notice period clauses has to be referred to for the notice period. If subsequently, a revised letter with new terms of the notice period is issued, then the same holds good. So, whatever has been communicated recently stays—in your case, the employer having a one-month notice period, and your claim of three months has not been understood properly.

Kind regards, Dayanand
