Is it mandatory to register under the Bombay Shops and Establishment Act for any firm? The firm is situated in the Grampanchayat Area of Thane District in Maharashtra.

Hi Ganesh,

Yes. It is mandatory that you register your establishment under the shops and establishments act. All establishments other than factories need to be registered under this act within 30 days from the date of commencement of business. If you do not do this, in case of inspection, you might have to pay penalties.

Here are the formalities:

1. For registration the employer has to apply to the Sr. Inspector (Shops & Establishment) of his respective Municipal Corporation of Greater Mumbai Wards in the prescribed form ‘A' togetherwith requisite fees .

2. Form ‘A' must be accompanied by the authentic documentary proof as regards rightful and exclusive possession/ occupation of premises and also the proof of business conducting.

Such documentary proof shall be in the nature of rent receipt of premises, consent letter from principal tenant, valid leave agreement, electric bill, ration card, property tax bill, Allotment/ occupation certificate of premises, business transaction proof, partnership deed, memorandum of articles, incorporation certificate etc. as deemed to be satisfactory to the Sr. Inspector (Shops & Establishments) Wards.

Registration Certificate is granted for one callender or three callender years depending on the option exercised by the employer.

I just want to know, in case an establishment with minimal power consumption has been started with 15 employees, does it need to be registered under this act immediately? What happens if the number of employees exceeds 20 at a later point in time?

When should the registration be obtained in such a scenario?

Additionally, what are the implications if the employees are outsourced and not on the company's payroll?

Hi Archana,

You are right. However, on the day when the employee strength reaches 20, you need to get the registration done. For employees who are outsourced, it is the responsibility of the principal employer to get this done. Hope this clarifies.

Is the Shops and Establishments Act applicable when there are no employees? What should be the number of employees for the provisions of the act to apply?

I am planning to launch a web portal. To manage the portal, I will be outsourcing the work to other agencies. These agencies will work either at their own place or may work at my place for a brief period. I may choose to have one or two employees. Please guide me on this matter.

Is the threshold of 20 employees per location for an organization? For example, if I have more than 20 employees at one location and 5-6 employees at another, do I have to get both locations registered?

Hi All,

Please note that the registration of establishment is required even though the number of employees is nil.

Secondly, I want to add to your knowledge that in some villages (areas), the act is not applicable, e.g., Raigad district is not coming under the purview of the Bombay Shops and Establishment Act. The areas/villages which are not covered under the Bombay Shops and Establishment Act will come under the purview of the Bombay Village Panchayat Act. Under this act, registration is not required.

Please let me know if an IT company with a staff strength of around 65-70 employees needs to proceed with Shop and Establishment registration. My company has just completed that registration, and they have requested me to maintain books and leave cards for all 70 employees. Is this the standard procedure followed everywhere?

Furthermore, do large companies with over 5000+ employees also undergo the same process?
