Industrial Doctor and Male Nurse Requirements

Is it compulsory to have an Industrial Doctor and a Male Nurse as per the requirements? Do you think having them is beneficial for the factory, even though they belong to a nonproductive department?

The services of a Medical Officer and Nurse are compulsory as per the factory rules. The requirements vary for factories employing 50 workers, 51 to 200 workers, and over 200 workers.

According to the Kerala factories rules, the requirements are as follows: One full-time factory Medical Officer for factories employing up to 500 workers, and one additional Medical Officer for every additional 1000 workers or part thereof. There should also be one nurse, one dresser cum compounder, and one sweeper cum ward boy throughout the working period.

The numbers of doctors and male nurses are according to the fact act and as per the Gujarat Factory Rules. It is applicable when the factory has hazardous processes. When considering the numbers of doctors and male nurses, we should take into account only the numbers of workers who are engaged with the hazardous process instead of all workers of the factory. Basically, the language of the Factory Act is a technical language.

Appointment of Medical and Paramedical Staff in Factories

The Factories Act requires the appointment of medical and paramedical staff in the factory according to its nature and the number of employees. These days, such responsibilities are usually outsourced, although a fully equipped dispensary is maintained.

The Factories Act 1948, Section 45

[(4)] In every factory wherein more than five hundred workers are 5*[ordinarily employed], there shall be provided and maintained an ambulance room of the prescribed size, containing the prescribed equipment and in the charge of such medical and nursing staff as may be prescribed 6*[and those facilities shall always be made readily available during the working hours of the factory].

It mentions medical and nursing staff in general, but I think it does not state a binding requirement for a male nurse. The state rules (UP) do state that (Rule 67 sub-rule 2) and such subordinate staff as the Chief Inspector may direct: In this case, if the Chief Inspector directs for a male nurse, then it has to be so.

Doctors Required in Various Medical Fields

What kind of doctors or professionals are required in industries like Allopathy, Ayurvedic, Homeopathy, and Unani? Is there any specific criteria for that?

As per the Gujarat Fact Rules of 1963, Rule 71 specifies that a doctor should hold at least a B.A.M.S (Bachelor of Ayurvedic Medicine and Surgery) or G.F.A.M (Graduate of the Faculty of Ayurvedic Medicine) degree, along with a minimum of 6 months of experience.

Dear All,

As per Maharashtra State Factories Rules, the qualifications of a Medical Officer are as follows:

The Factory Medical Officer, required to be appointed under sub-rule (1), shall have qualifications included in the Schedule to the Indian Medical Degrees Act of 1916 or in the Schedules to the Indian Medical Council Act, 1956, and possess a Certificate of Training in Industrial Health of a minimum three months duration recognized by the State Government.

Provided that:

(i) a person possessing a Diploma in Industrial Health or equivalent shall not be required to possess the Certificate of training as aforesaid;

(ii) the Chief Inspector may, subject to such conditions as he may specify, grant exemption from the requirement of this sub-rule if, in his opinion, a suitable person possessing the necessary qualifications is not available for appointment;

(iii) in the case of a person who has been working as a Factory Medical Officer for a period of not less than 3 years on the date of commencement of this rule, the Chief Inspector may, subject to the condition that the said person shall obtain the aforesaid certificate of training within a period of three years, relax the qualification.

Dear All,

Please go through the below as per Maharashtra Factories Rules for a better understanding:

73-W. Occupational Health Centres - (1) In respect of any factory carrying on a 'Hazardous Process,' there shall be provided and maintained in good order an Occupational Health Centre with the services and facilities as per the scale laid down hereunder:-

(a) For factories employing up to 50 workers,-

(i) the services of a Factory Medical Officer on a retainer basis, in his clinic to be notified by the occupier. He will carry out the pre-employment and periodical medical examination as stipulated in rule 73-V and render medical assistance during any emergency;

(ii) a minimum of 5 persons trained in first-aid procedures, amongst whom at least one shall always be available during the working period;

(iii) a fully equipped first-aid box.

(b) For factories employing 51 to 200 workers,-

(i) an Occupational Health Centre having a room with a minimum floor area of 15 sq.m. with floors and walls made of smooth and impervious surface and with adequate illumination and ventilation as well as equipment as per the schedule annexed to this rule;

(ii) a part-time Factory Medical Officer shall be in overall charge of the Centre who shall visit the factory at least twice a week and whose services shall be readily available during medical emergencies;

(iii) one qualified and trained dresser-cum-compounder on duty throughout the working period;

(iv) a fully equipped First-aid box in all the departments.

(c) For factories employing above 200 workers,-

(i) one full-time Factory Medical Officer for factories employing up to 500 workers and one more medical officer for every additional 1,000 workers or part thereof;

(ii) an Occupational Health Centre having at least 2 rooms each with a minimum floor area of 15 sq.m. with floors and walls made of a smooth and impervious surface and adequate illumination and ventilation as well as equipment as per the schedule annexed to this rule;

(iii) there shall be one nurse, one dresser-cum-compounder, and one sweeper-cum-ward boy throughout the working period;

(iv) the Occupational Health Centre shall be suitably equipped to manage medical emergencies.

To work in any type of factory, a doctor should complete their MBBS from a recognized university and then obtain an AFIH diploma. This makes them eligible for such work.
