DEar Seniors,
I want to know that is training period of continue service is add to count the gratuity year count.
E.g Total service 5.2 ( 4.2 + 1 year training)
is it right !!!

For the calculation of gratuity, we take into consideration the date of joining. so even the probation or training period is included

Dear Asish,
Gratuity calculation is based on the joining date up to completion of 1 year. This is a general rule. You can even ask other HR professionals in other countries. In cases that an employee underwent for a training on or before the completion of his 1 year of service, it is included.
Computation of such varies as per their respective laws of each country(i.e. 7 days / year; 14 days/year; 21 days/year).

can we put an employee from regular payroll to probation???
eg... one employee was from the first day on payroll that is in basic+pf+bonus system... now can we put him in probation in ctc system?? pl guide

Dear Amit,
How many payroll register do you have? Do you have 1 for proby employees and 1 for regular employees? In all cases, you should have 1 payroll register that includes all your staff regardsless of their status. You can include in the payroll register their designation and joining date in order for you to verify their status.
This will help you guide in checking their sick leave eligibility. Only upon completion of 6 months probation period they are entitled for sick leave. Nevertheless, you can verify you payroll register for a month in one glance.

There should be a single payroll register, else it'll be difficult to track as and when the company expands.
In my company, Gratuity is calculated from date of joining. (our employees are called trainees for the first 6 months). PF/ESIC and other statutory benefits are mandatory since day one of his joining the company.
However this can change according to the Policy, within the company. If the Trainee is not considered as a permanent workman, he may be placed on a temporary payroll. But if he is in the Regular payroll, it is better on legal point also to consider all the benefits from day one of his employment.

Please clerify that what you have paid during training period stipned or salary, than after the clerification can be provided.

Dear Ashish,
According to the Payment of Gratuity Act. 5 years of continuous service, employee will be eligible to receive Gratuity. Training period is a part of Continuous service. Here the continuous service is an important word.
If a trainee has been terminated or issued a letter of completion of Training after the tenure of one year and reemployed as a fresh employee with a break in service, it will not be treated as Continuous service. Pl look at this case based on this. If an employee is working without any break in service right from the date of training he will be eligible for Gratuity for 5 years. Formula I suppose you know : Basic + D.A / 26 * 15 * No of years service (in this case 5 years)
