Understanding "Employment Injury" Under ESIC: Does It Cover Accidents Outside Work Hours?

pulsar180
You are all requested to provide me with the exact definition of "employment injury" in respect of an accident report under the ESIC Act. If an employee meets with an accident after duty hours and outside the office/factory premises, will it be considered for any benefits from ESIC?

Submitting Accident Reports Under ESIC

Note: Now, after introducing esic.in, how can we submit the accident report? The site has Form 12 from the employer side. Earlier, I think Form 16 had to be submitted in any accident case at the local office within 24 hours.

Employment injury means a personal injury to an employee caused by an accident or an occupational disease arising out of and in the course of employment. There are some cases where accidents occur outside the premises, even before and after working hours, which should be considered for the insurable amount.

For the Employer's Side:

- Form 11: Accident book
- Form 12: Accident Report from the employer
- Form 16: Claim for periodical payment of Dependent Benefits by IP/Beneficiary.

Thanks,

Chandan

Employment Injury and ESIC Benefits

Following a recent amendment to the ESI Act, an injury caused to an employee while commuting from their residence to the place of work and vice versa is also treated as an employment injury for availing benefits from ESIC. This is applicable provided the time and place of the accident align with the employee's usual time and route of commuting.
