Stuck with PF Withdrawal? How to Access Your Funds Without Employer's Help from Another City

Hi all,

I worked in a branch company in Chennai. The main branch is in Hyderabad, so my PF account was opened with the Hyderabad PF office. I submitted my PF claims form 10, but the amount has not been transferred. The previous company is not responding to me. Is there a way to withdraw my PF account in Hyderabad (I am in Chennai now) without my previous employer's help?

Dear Narasingh,

I would like to inform you that if you wish to transfer your PF Accumulation, you will need to fill out PF Form-13 to transfer the funds from your previous employer to your current employer. Furthermore, I would like to update you that your current employer will submit the Form-13 to its respective EPFO office (along with the Form-3A issued by the previous employer in case you left the job in the current financial year).

If you have left your previous employment, then only you can apply for withdrawal benefits. If you cannot get the attestation from the previous employer, you may obtain Form 19 and Form 10C (for withdrawal of PF and Pension, respectively) attested by your Bank Manager (or any gazetted Officer, MP, MLA, etc.) and send it directly to the Assistant Provident Fund Commissioner of the EPF Office where your PF accounts are maintained. The EPF Organization will collect Form 3A regarding you from your (previous) employer and transfer the amount to your bank account. Remember, with the introduction of NEFT, you have to attach a canceled check along with your claim forms.

No ASR or bank cheques are to be sent to PF. You have to carefully fill in Form 19 & 10 C for withdrawal of PF and Pension Fund, which is available in the local PF Office. Fill in your details along with your PF Account No. and Bank A/c No. (where you want the money to be sent by PF Deptt) properly. Don't forget to affix a Re.1/- revenue stamp and sign on the advance receipt portion of the form. Deposit the form in the PF Office (after attestation from the Bank Manager, or Gazetted Officer, or local MLA or MP). The PF office will issue you an acknowledgment slip. Until you receive your PF, follow up with PF Deptt. with the details given on the acknowledgment slip.

Dear Narasingh,

I understand that your current company in Chennai has a different PF registration code from the Hyderabad branch. If that is the case, you should submit Form 13 instead of Form 10 to transfer your PF accumulation from Hyderabad to the Chennai PF office.

Procedure:

A. Fill up Form 13 and submit it to your current employer.
B. Your current employer will then forward it to the local PF office in Chennai.
C. The Chennai PF office will request your balances from the Hyderabad office.
D. Hyderabad PF office will transfer the balance and details of your account to the Chennai PF office in reply (sometimes with intimation to the PF member).
E. Upon receiving the account details, the Chennai office will transfer the balance amount to your Chennai account for accumulation.
F. You will be informed by the Chennai PF office about your PF transfers when issuing PF account slips for the year. Alternatively, you can contact the Chennai PF office one month after submitting Form 13.

Dear Sunil Sadar,

Let me confirm that with the introduction of National Electronic Fund Transfer (NEFT) by the Employees' Provident Fund Organisation for transferring the PF accumulations (as well as for availing advances from the PF account) directly to the beneficiary's bank account, the member has to attach an attested copy of the bank passbook (front page showing the account number and name of the customer, i.e., the PF member, or a canceled cheque leaf of the bank account to which the amount has to be credited.

Narasngh's query was relating to the withdrawal of PF and not the transfer of the PF account to his current account.

If I have resigned from my services and want to withdraw my PF amount, what will be the role of my previous employer? How can I get my amount in my account?

Dear Mr. Narasingh,

PF transfer to the new company account could be done by applying to the Hyderabad Regional PF office in the form 13 through the new employer. If you want to withdraw the PF amount from the previous PF account, then you have to fill up the PF forms 19 and 10C along with a photocopy of your operating bank passbook or a canceled check in your name and get the same attested by the Bank manager or any gazetted officer. The regional office collects the form 3A from the previous employer, and your PF amount will be deposited into your bank account within 45 days.

PF accumulation can only be withdrawn after the attestation of Form 19 & 10C by the previous employer from whom you are claiming to withdraw. Therefore, the role of the previous employer in the withdrawal of PF accumulation is important and significant.

Dear Sumit,

It is the duty of the employer under the Act and Scheme to help the Employees' Provident Fund organization settle the Provident Fund dues of his employees. He has to complete the prescribed application within 5 days of receipt [para 72(5)] forms and hand it over to the member when they leave the service. When a member finds it difficult to get the form attested by the employer, they can get the attestation of any of the following officers and send it to the Provident Fund office:

1. Manager of a bank.
2. Any gazetted officer.
3. Member of the Central Board of Trustees/committee/Regional Committee (Employees' Provident Fund Organization).
4. Magistrate/Post/Sub Post Master/President of Village Panchayat/Notary Public.

However, when a member finds it difficult to do so, they may approach the listed officials as described by you. These officials can only attest the form if the establishment is closed. If the establishment is still operating and a claim is submitted for settlement with the attestation of these officials, the claim must be sent back to the company for verification. Only if the claim is verified by the company, the EPFO claim will be settled. The role of the previous employer in the settlement of EPFO claims is not just important but crucial.

It is not mandatory to take attestation from these officials only in case of office closure. You can also seek their attestation if the previous employer has not signed the PF claim forms. Additionally, you can request the PF Commissioner to intervene in this matter through a written request. No employer can withhold your PF claim for settling dues.

I enquired about your point regarding Claim Attestation. There is no provision for getting the signature from any Gazetted officer, as the PF official mentioned. I faced the same issue. Could you please clarify this again?

You are right, Kapil, that no employer can hold the PF of any employee, and a request to the PF Commissioner has to be forwarded for intervention. If the PF Commissioner intervenes, he has to send his official or forward an order to the previous employer enclosing the EPF claim to be signed, so that the claimant will benefit.

My friend worked in Hyderabad, and the head office is in Bangalore. He worked from 1997 to 2008.
