Incident of Vehicle Impoundment
Dear Madam/Sir, Company's Vehicle (Truck-mounted crane) while on its way back to the office from the Yard was stopped and impounded by the traffic police due to a violation of a traffic rule. The incident occurred at the flyover, as our vehicle was following a heavily loaded vehicle that was unable to move smoothly. Our driver attempted to overtake the front vehicle from the right-hand side successfully, and after 500 to 600 meters, the traffic police stopped the vehicle due to the violation of overtaking. They challaned and impounded our vehicle at Punjabi Bagh, Delhi. The incident happened on 12-09-2010 (Sunday). I visited the Traffic Police station and completed the formalities on Sunday itself.
For not obeying the traffic rules by the driver, the company was challaned as punishment for the violation of a traffic rule, and the vehicle was impounded at Punjabi Bagh, Delhi for a compoundable offense. A challan was issued to us by ACP (T) and we were asked to appear on 13-09-2010 before the Metropolitan Magistrate in Rohini Court for the penalty. Accordingly, I and another staff member from the Plant Dept. appeared in court and paid Rs. 2,100 as a penalty, and the vehicle was released on the same day.
On the same day, 13-09-2010, the ACP, Traffic West District, Delhi, issued a show-cause notice to us to appear on 24-09-2010 to finalize the matter. Violating traffic rules and once a penalty is imposed, it is common practice for the vehicle to be impounded for 7 to 30 days by the authorities concerned.
Can anybody share their experience and help me in drafting the reply to prevent the vehicle from being impounded again? I have enclosed the ACP notice also.
