Fresh Graduate Dilemma: Can I Leave My Job Without Notice and What Are the Risks?

madhutalaari
Hello group, I am a fresh graduate who graduated in 2010. I joined a company one and a half months ago. I have not signed any bond, and no work has been assigned to me yet.

Current Situation

The problem now is that I cannot stay there as I do not like the company. I feel alone and left out in the company. I tried looking for a better opportunity than my current company, and fortunately, as I am still a fresher, I got a new and better job, and now I want to leave.

Notice Period Dilemma

The company is asking for a 2-month notice before leaving, but I only have 15 days to join the new company, after which I cannot join. When I enquired with some people, they suggested leaving the company without informing them (which is called absconding).

Potential Legal Consequences

If I leave the company without informing them, what kind of legal action could they take against me? Would it be in monetary terms, or could it lead to jail time?

I do not plan to go back to them to ask for a relieving letter since I was not assigned any work or given any training. I also do not intend to request an experience certificate as it does not apply to me.

Seeking Advice

What would you suggest I do? And if I leave the company without informing them, what could be the consequences?

Dear Madhu,

As there is no bond, no jail or monetary terms will be involved. You can leave the company without any hassle and enjoy your new job.

Leave and enjoy your new job; nothing will happen. Although it is against your offer letter because the notice period is a mandatory term that needs to be complied with.

Kindly take legal opinion from your advocate. The industry practice is that a company can claim this amount by registering a civil case against him.
