Termination Process: Can We Fire an Employee for Indiscipline Without Prior Warnings?

Can we issue a termination letter to an employee on grounds of indiscipline? As far as I know, we need to issue a verbal warning, then three warning letters, show-cause notices, and then finally the termination letter.

Kindly clarify the procedure for issuing a termination letter.

Yes, Tittli, you can do it. Additionally, you should also include one main point in your list - "Explanation Letter" from the particular employee regarding the action. Ensure that the warning letter clearly states the possibility of "termination from service" if the misconduct persists.

Whether the issue is minor or major, is it mentioned under the Standing Orders or Conduct Discipline rules of the organization? For example, coming late by 20 minutes can also be called "indiscipline." Is the employee concerned a "workman" or in a managerial cadre? You have rightly pointed out the "verbal warning, then 3 warning letters, show-cause notices, and then finally a termination letter," etc. These are the "due process" that every ethical organization follows.

On the other hand, you can act as per the opinion given by Mr. Mahr. There are no "preventive laws" that can stop you from committing such acts. Many organizations get away with such things, making it a general policy—a lie repeated 100 times, apparently appears to be true.

If the person falls under the workmen cadre, generate evidence against each warning letter (ask for written explanations). Also, conduct a departmental enquiry. Based on this enquiry, you can issue a termination letter.
