Dear Member,

Please tell me the difference between the Works Committee and Grievance Committee, with some examples.

Thanks in advance.

Dear Manoj,

The formation and functioning of the Works Committee are as per statute, whereas the formation and functioning of the Grievance Committee is a management initiative and an important aspect of effective employee relations. For example, the number of members in the Works Committee is equal from the management side and the employee (through the union) side. The number of members on the Grievance Committee is an option exercised by scrupulous management.

Thanks & Best Wishes,

Thank you for providing clarity on the matter. Could you please share a format for a works committee in the service industry (IT & ITES)?

I may make a correction that both the Works Committee and the Grievance Committee are statutory, and the functions of both these committees remain the same. The Works Committee is required in establishments where 100 employees are working, whereas, by virtue of the new amendment to the ID Act (section 9C), the Grievance Committee is required in every establishment where 20 or more employees are working. In the Works Committee, there is no compulsion for women members to be present, whereas in the Grievance Committee, it is mandatory.

Can anybody suggest to me what the duration is between two meetings, such as Grievance Committee meetings, Work Committee meetings, Safety Committee meetings, Welfare Committee meetings, and Anti-Sexual Harassment Committee meetings?

To constitute a Works Committee, is the order of the Appropriate Government mandatory?
Madhu.T.K
No, no order of the Appropriate Government is required for setting up a Works Committee; rather, it is a requirement of the employer under the Act.

Hi All,

I am in urgent need to know whether the Works Committee is applicable to all industrial establishments with 100 or more workers, only to those where there is an appropriate government order to constitute the Works Committee. If it is applicable, please provide me with evidence that I can show to my colleagues, as they require evidence. I hope the seniors and all others understand the concern.

Please reply urgently.

Thank you.

Regards,
Smita
