Gratuity Eligibility Question: Does Time on Deputation Count Towards My 9 Years?

I have been with my company for 9 years, out of which 4 years I was on deputation in Japan. Would I be eligible for gratuity for 9 years or 5 years?

You will receive gratuity amount for 9 years of service. If anyone works more than 5 years in one organization, regardless of the location, whether the employer is the same or not is important.

I had been working in a central government organization for 1 year and 9 months on deputation. After that, I returned to my parent concern. Is the organization that took me on deputation liable to calculate my gratuity and pay that amount to my parent concern?

Hope the parent concern is also a central government enterprise. If so, your deputation will be treated as service for the purpose of gratuity calculation. Also, hope that the same Payment of Gratuity Act, which applies to public sector undertakings only, is applicable to your establishment. Otherwise, you may have to refer to the gratuity rules applicable to government employees.
