Facing a Salary Hold After Resigning: Can I Take Legal Action to Get Paid?

Dear all,

I was working in Ltd company as a trainee in charge for the last nine months. However, they did not confirm me because there was a change in management. A new boss was recruited, and he wanted to bring in his own person to replace the existing employees, which included me and another colleague.

I had already secured a new job when, just before the release of my salary for the last working month, my boss became aware of it. He then instructed the HR department to hold my salary. I decided to resign and asked about the release of my salary and other dues, but they did not provide a positive response.

As I am a trainee, there is no requirement for me to give a notice period as stated in my job offer letter. Can I pursue legal action in this matter, or do you have any other suggestions on how I can obtain my salary/stipend?

Fight legally? Why go there and ask them politely. If they tell you to rejoin, go ahead. Otherwise, ask for the benefit of whatever you have worked for so far politely. Let's see what other HR professionals reply here.
