How Should I Handle a Silent Manager During My Notice Period in Probation?

brijesh_techno
Hi, I am an IT engineer, and as per my appointment letter, it is clearly mentioned to serve a one-month notice period after resignation. I have resigned, and in my resignation letter, I have given the notice period of one month with the last date mentioned as well. However, after resigning, my reporting manager is not replying. It has been almost 20 days, and I have sent 4 to 5 follow-up emails, but he still has not accepted my resignation or replied. When I have called, he is not providing me with proper answers. The company has sent one person for the handover of my responsibilities, and I am cooperating with the process. I will soon send the handover completion email.

My concern is if they still do not provide me with the relieving letter, what should I do on my last working day? Additionally, I am in the probation period.

Regards,
BK

Hi,

Can someone please advise? My notice period is nearing completion, but I am not receiving any response from my HR team or reporting manager.

If you have not given a notice period, your organization doesn't have the right to withhold your experience letter if you have paid them the due amount of the notice period. If you have given a notice period, then also they don't have the right to hold your experience and relieving letter. I would suggest you please speak to your HR team face-to-face and get an idea as to why they are holding your experience and relieving letter.

Professional/Legal Opinion Needed on Resignation Scenario

I need a professional/legal opinion on this scenario. An employee resigns and requests his employers to relieve him early, stating his willingness to pay the penalties in lieu of the notice period. He has also explained his constraints as to why he cannot extend the notice period, which is 30 days from the date of resignation. The employers have accepted his resignation but haven't confirmed the date of relieving yet and are still negotiating with him to extend, which he cannot accept due to his constraints.

In these circumstances:

1. Does the employee have the right to demand release on a certain date upon payment of all penalties and dues?
2. Does the employer have any right to make the employee stay longer?
3. Is the employer liable to face any legal risk from the employee?

The appointment letter states that either party can terminate the employment by giving one month's notice or notice pay (salary) in lieu.

Kindly advise asap.

Hi, my friend has recently received an excellent job offer and is required to join in a week's time. The problem is that he has resigned and has requested his manager to waive the notice period and release him earlier. The manager has accepted the resignation but has not confirmed an early relieving date. My friend is willing to pay for the notice period shortfall. I would also like to add that my friend is facing severe mental harassment from his current manager, who is threatening to ruin his career if he reports this matter to HR or anyone else. Please advise.
