Once an employee has an ESI No., the same should be used at the time of rejoining the employee. Because of the Smart Card phenomenon, there are no Temporary/Permanent Cards anymore. I agree with your first point only. Anyway, I will educate our members about this:
- Try to think about the problem practically. Every ESI branch office has its own block numbers for allotting Insurance Numbers to the employees working in the factories/establishments within its jurisdiction.
- For certain diseases to determine the benefit amounts, we need to consider his insurable employment for the last two years. Hence, while taking steps concerning the newly joining employee who is already covered under ESI in the previous unit, the following steps should be followed by all HR personnel:
Steps for Handling ESI for Rejoining Employees
1. When the new employee discloses that he is already covered under ESI and has the particulars of the ESI No., you have to fill up a form called ESIC-53 and submit it to the Branch Office concerned where the new factory/establishment falls. The Branch Office will then obtain his previous records such as 'Declaration Form/Ledger Sheet/Returns Particulars' from the previous ESI branch office to which the previous factory/establishment was attached.
2. After receiving the previous Declaration form, they will allocate their running ESI Block number in place of the old number, and the same number will be reflected against his name in the respective returns. Though he is allotted a new number, by virtue of having his old particulars, he will be treated as under continuous insurable employment and entitled to all applicable cash benefits.
3. If the previous factory and the new factory fall within the same Branch Office jurisdiction, he has to submit ESIC-53 with particulars of the change of employer details, in which case he has to use his previous number only.
After Computerization
1. If he was previously provided with a Smart Card, there is no issue. After joining the new company at the Branch Office, they will only change the employer details in the software since after computerization, there is no need to change your ESI number as your card details are permanent.
2. Even with Computerization in place, it is better to request the issuance of Temporary Cards. After enrolling in the Photo Camps, it will take a minimum of one month to receive your cards. Until then, what is the fate of the Insured Person regarding medical facilities? Hence, it is always better to have a temporary card until you receive the Smart Card.
