Understanding ESI and PF Applicability for Agency Employees and in the Construction Sector

Is ESI and PF rules applicable to the employees hired from other agencies? What if they are already covered under ESI and PF from the agency itself?

Please let me know if you need further clarification on this matter.

Dear Shreekanth,

If an agency already has ESI/PF codes, the principal employer simply needs to verify their records, not to have them covered again.

ESI has to be deducted at 1.75% on gross salary up to 15000/- per month without overtime. All other components of salary have to be considered. PF is to be deducted at 12% up to basic of 6500/- per month, and it is deducted on basic+DA (if any).
