Left Job Without Notice: Can I Claim My PF Without Paying a Month's Salary?

Hello,

I have worked for a leading food chain and had left the job without serving the notice period. Also, I did not claim my PF at that time. Now, when I discussed this matter with the regional HR, she is asking me to pay one month's salary. Is it necessary to pay one month's salary for claiming? Can I get my PF without paying one month's salary? Is there any other way? If there is, please suggest me.

Also, please inform me about the procedure for claiming PF.

Whether you pay your one-month basic or not, THAT DOESN'T MATTER. NO ONE CAN HINDER YOU IN WITHDRAWING YOUR PF AMOUNT. THAT'S FINAL.

Dear Dipak,

PF is retained by the Govt., hence the organization cannot create obstacles. The only concern is that the employer has to attest your withdrawal forms. However, if you want to avoid them, you can also get it attested through your bank manager and any gazetted officer. You need to have your PF number, date of joining, date of leaving, and if the return is not submitted, then you also need to attach contribution card- 3A.

Bank managers or gazetted officers are only authorized to attest the withdrawal forms when an establishment is closed. When an establishment is in the existing stage, you must go to the company for withdrawal form attestation. If the attestation is done by the above-mentioned officials, the form must be sent to the company for verification. If the employer is not willing to sign the same, you may approach the EPFO office where your branch is covered. They will take action against the officials. Lastly, no one can hinder you in withdrawing your PF amount. That's final.

I have been through the same situation, but I managed to get my money. You are suggested to go to the PF office and ask for your PF details. If you have your PF number with you, that's good. But if you don't have the PF number, you can simply tell the manager at the PF office about your company/organization. They have the list of all the employees and their entire PF records. However, if you have left the organization in the current financial year, then your records will reflect in the next financial year.

Alternatively, get the PF details from your organization using RTI. No one can stop you from claiming your own PF.
