Employment Age in India: Can We Hire Someone Over 60 in the Private Sector?

Anu Mishra
What is the maximum age of employment in India (private sector)? Can we employ any person above 60 years as a regular employee (company payroll)? Please confirm.

I have a similar query. A management staff member from one of our companies has retired at the age of 60. Considering his skills and experience, we are interested in hiring him as a new employee in our group company. Is this feasible according to legal requirements? What might be the terms and conditions for his appointment? Can someone provide insight on these topics?

You can employ him on a retainership basis. There is no age limit for retainers. I remember we used to give employment to many retired officers on a retainership basis who were in the age range of 60 to 86 years. The PSAR Act 2005 gives an age limit of 65 for private security guards.

The regular age of employment is what we are talking about, only concerned with PF, gratuity, ESIC (say all compliance). So kindly go ahead and give employment to deserving candidates.
