How To Get My Pf Amount In Case Of Employeer Does Not Diposite The Pf Amount?

Barendra Krushna Swain
Dear Sir,

I resigned from a company 4 months ago, and now I want to withdraw my PF. The issue is that the company has not deposited the PF amount for over a year. Kindly suggest to me the procedure for withdrawing my total PF amount.

Thanks,

Hi all,

PF cannot be stopped by any employer under any circumstances. If the employer is unwilling to release the PF amount, then fill out the PF withdrawal form. Attach a letter, your last payslip, a copy of the resignation acceptance, and the exit clearance document. Send these documents to the PF commissioner without the employer's seal and signature.

Once the commissioner receives the set of documents, he will contact the employer to inquire about the missing stamp and signature. The employer will be given 15 days to provide an explanation. The reason may go against the employee, but the PF is the employee's right. Subsequently, the PF withdrawal form will be returned to the employer for signatures and a stamp. The employer will then resend it to the PF department.

After 60 days, the PF amount will be transferred to the bank account mentioned on the PF withdrawal form.

FYI: Bank manager signatures or signatures of any gazetted officers are also valid if the employee refuses to sign the form.

Hello, this is very useful. But please tell me what will happen with the same scenario but the company is also getting closed within one week?

You may file a complaint with the Enforcement Department at the PF office if the employer has deducted an amount but failed to deposit it with the PF authorities. They will take this issue seriously and may attach the property until the default is rectified.
