Can We Take Legal Action for Unpaid Work Without a Contract? Seeking Advice on Next Steps

Hi,

I joined a company as an agent, but the process went on hold one day. On the same day, another process holder asked us to work on his process. They did not give us an appointment letter, and my previous employers said that I could join the new company. We worked for two weeks, but the clients rejected most of our work (Telephonic Surveys), and our employer did not get paid. The process was only for two weeks initially, with the promise of continued work if the clients were satisfied. However, due to a discrepancy between the client and the employer, they never continued with our service. Instead, we were offered to work on a commission basis for a different type of process involving sales. We were informed that we would only be paid or our jobs would only continue if we made a sale within 15 days. Only one person came close, but the 15 days elapsed without any sale occurring. As a result, none of us have been paid for the time we worked.

Can we file a police complaint against the employer? Does it have to be against the Director and the operations manager or the company, which is no longer functioning? We do not have an offer letter or appointment letter from this company.

Please advise.

Dear Sujit,

It is okay. Please let me know the following things:

1. Salary slip or Salary Voucher given by the company.
2. Any email copy establishing your relationship with the employer.
3. Any salary register you have signed.
4. Any attendance register in which you have signed.
5. Telephone bill of the company.

Any document that can serve as proof of establishing your relationship with them would be enough to pursue legal action.

Dear Sujit,

It is not a matter of no money or anything else. The issue is that he has employed you and has to pay wages for the work. Could you please let me know how you received your salary, by cheque or cash?

We never received any salary. The process involved completing an order within a 2-week timeframe. If the quality met expectations, the client was expected to provide additional business. Unfortunately, due to quality issues, the process was discontinued, and as a result, we were not compensated for the 2 weeks.
