Leaving Your Job Without Notice: How to Handle PF Application When Moving States

I want to leave my company without notice. Now I am transferring to another state. What can I do before leaving this city to apply for the PF without concern with the company (to avoid coming back to this city)? Or can I apply from the new city after transferring (by attestation from Gugitted and submitting to the PF office).

In a transfer case, you do not need to get it attested from the previous company. Only the new company has to attest it. You simply need to have your PF account number from the previous case.

In a withdrawal case, it is mentioned on the PF form (form no.13) who the other authorities are to attest it other than your company (some of these are any gazetted officer/manager of your bank) and it can be directly deposited to the PF office. However, in all cases, you need to have your PF number, date of joining, and date of leaving.

If I changed to another city, do I need to submit the attested PF form in the old (previous company's) city only, or can I submit it in the new (new company's) city as well?

Dear Prasad,

If you change to another city, then you need to deposit the form in the old city (to deposit with the regional/sub-regional PF office of the old city, not with the old company).

For withdrawal, it's Form No. 19 and 10 C, not Form No. 13, which is used for transfers.

Dear All,

For 19 & 10C, one needs to fill it up and get it certified by the previous employer. It has to be submitted in the concerned office of the previous employer.

For Form 13, one needs to fill it up and submit it to the present employer. The present employer will then submit it to the concerned PF office.

It's almost six months since I have not received my PF withdrawal. The previous company has not yet deposited my claim to the PF office. Can anyone advise on what can be done for this?

Please contact the concerned HR of your previous company about the delay in submitting your claim.

Alternatively, please fill out the form once again and hand it over to your previous company's HR department personally, then follow up with them. In another scenario, you can submit the PF claim form directly to the city PF office, duly attested by a gazetted officer or bank manager, etc. This might help you.

Dear Prasad,

If you want to withdraw, you should collect a PF withdrawal form and submit it to your old PF office with an attestation from your bank manager (at your old place). After submitting the form, the amount will be transferred to your bank account within 2 months.

If you want to transfer the amount to your present employer, you will need the signature of your old employer. In your case, this might be challenging. It may be better for you to withdraw the money following the procedure mentioned above.

Dear Mr. Prasad,

According to the EPF Act of 1952 and my knowledge, there is no provision for withdrawing PF amount from the PF office unless the previous company provides attestation. If you wish to transfer your PF amount from your old account to a new account, you can apply using transfer form 13 at your new employer's organization.

Dear Sir,

I am Gian Singh. I want to claim my previous PF Fund for the year 2007-2008, covering 11 months. Even though I was not confirmed as a computer operator in the office during the 11 months, which included a 6-month probation period. However, the employer states that if an individual has worked for 240 days, they are automatically confirmed. Therefore, they are insisting on a 2-month notice period or a deduction of 2 months' salary.

Please provide me with your top suggestions on this matter.

What exactly are your questions?

1. PF: It has nothing to do with your probation or confirmation. It should simply be deducted from your salary and deposited to the concerned regional office. As far as withdrawal is concerned, PF can only be withdrawn after leaving an organization. While remaining in service, you cannot withdraw.

2. Probation/Confirmation: Just read your appointment letter. What are the clauses? Have you been given a confirmation letter?

Just open the site, etaxindia.org, and read about tax liabilities on PF. I am not sure, but probably no tax is deducted if PF is withdrawn through a regional/sub-regional PF office.
