How to Draft a Legal Appointment Order for a Service Technician Without Employee Benefits?

prabu1984
Appointment Order Format for a Non-Employee:
Ours is an FMCG company. My management wants to take a person as a "Service Technician" and would like to pay him only a consolidated pay, without PF, ESI, or any statutory bindings of an employee.
Please share your valuable suggestions on drafting an appointment order. I don't want to face any legal or statutory problems because of this.

Thanks in advance.

You cannot issue an appointment order and also escape from statutory liabilities such as PF, ESIC, etc. However you draft an appointment order, you carry the responsibility of compliance. If not done so, you carry the risk of getting sued.

If your company does not want to undertake the statutory bindings of compliance with labor laws, you may outsource the jobs. But again, as a principal employer, it is your responsibility to ensure compliance for those employees. And, of course, you have to pay for it.

Best of luck,

Prashant
