Stuck in a Job: How Can My Relative Resign When His Notice Isn't Accepted?

meenakshi_sma
Dear Sir/Madam,

This is for my relative. He is currently working as a lecturer in an engineering college for 1 year. He wants to resign from his current organization due to personal reasons. He submitted the resignation letter one month ago and has been fulfilling his duties for the last month. In the appointment letter, it is mentioned to either give a 3-month notice or pay the base salary for three months. Due to his personal problems, he is unable to provide a 3-month notice, so instead, he has served for 1 month and is willing to give 2/3 months' salary in lieu of notice.

The organization has not accepted his resignation, has not provided a relieving letter, and has not specified the reason for not accepting the resignation. They are holding his certificates. He does not know what to do and cannot continue working there after one month. Please advise on how to proceed further.

Thanks,
Meena

It is advisable to obtain a relieving letter from your current organization. If your current college does not provide a relieving letter after showing willingness to pay the necessary notice pay, it is advisable to send a notice to the current college along with a cheque for the notice pay. Ask them to provide the relieving letter with immediate effect in reference to your resignation. Furthermore, if your relatives require to work for another private company and a relieving letter is not required, wait for action from the college.

Thank you for your suggestion.

In case they don't agree to accept the resignation, is there any legal way to proceed? If so, what kind of evidence is required?

Can you clarify the reason for resigning? Can your relative work for any other private company?
