Urgent Help Needed: Employee's PF Withdrawal Delayed Amid Daughter's Surgery Needs

In the case where the employer has submitted PF forms and Form 3A of the employee to the PF office, and there is nothing wrong with the forms, but the employee has not received his PF even after six months, certain actions can be taken. Initially, when the employee tried contacting the PF office, they did not answer the phone calls. Upon visiting the office in person, he was informed about the amount of his PF and assured that his cheque would be deposited within 10 to 15 days. However, it has been a month now, and he still has not received his PF.

The employee is in urgent need of the money as his 4-year-old daughter requires heart surgery. This is a critical situation that needs immediate attention. The case pertains to the Thane PF office in Mumbai.

Can any of my seniors assist in resolving this issue for the employee promptly?

Steps to Address Provident Fund Issues

Write to the Assistant Provident Fund Commissioner with a copy to the Regional PF Commissioner. If no reply is received nor amount credited to your account, file an application under the Right To Information Act. Submitting PF Forms to EPFO

If the company has not filed returns (Form 10) and has not forwarded Form 19 and Form 10C (submitted by the employee) along with Form 3A, then the file would not get processed at the EPF Office. In such a case, the employee can submit Form 19 and Form 10C directly to the EPFO after getting his signature attested by the Manager of the Bank to which the account is to be credited. A gazetted officer, MP, MLA, and other persons authorized by the EPFO in this respect can also attest the forms. Upon receiving the forms, the EPFO will order the employer to furnish Form 3A and other details like a break certificate.

Please wait for another 10 days. If you do not receive your cheque (IN Account) within this time, please lodge a complaint with the grievance cell at Bhikaji Cama Place, New Delhi. They will provide you with a complaint number. By quoting your complaint number, you can inquire about the status of your P.F. Please clearly mention the details of the P.F. office where your account is being maintained, your P.F. number, company name, date of submission of the form, and provide copies of any letters written.
