If your friend died while working, then his dependents would be eligible for ESI benefits. Otherwise, his dependents are not eligible for any compensation under ESI, except for the funeral benefit of Rs. 3500/-.

Dear Friend,

During the course of employment, if an employee passes away, their dependents can receive a funeral expense of 5000 rupees by completing either form 25A or 26. These forms should be filled out by the employer.

Don't get confused with many replies. As an ESI Manager, I will clarify your doubt:

i) If he died due to a non-employment injury, his living elder family member will receive ₹5,000.00 towards funeral expenses. They need to fill out the form, which should be countersigned by the employer.

ii) If he died due to an employment injury (i.e., during his duty timings), his dependent family members will receive a pension.

As the ESI Manager said, please don't get confused with too many replies. A month back, the ESI Act was amended. In it, they have included:

1. Accidents arising out of and in the course of employment are covered under ESI for all the benefits. (Arising out of = journey from residence to office and vice versa).
2. Kindly file an FIR if an accident arises during the journey from office to home or vice versa.
3. Obtain the death certificate.
4. Attend the legal hearing from the Local Thasildar and meet the deceased employee and employer with all the above documents.

If your friend's death is due to a non-employment injury, the dependents will not receive anything except funeral expenses up to Rs. 5000/- or the actual expenses, whichever is lower.

Employment Injury Benefits

In case the death is due to an employment injury that occurred during the course of employment or out of employment, which includes the reasonable journey time from the office to home and vice versa, the dependents will receive periodical dependents' benefits as per the rates prescribed under Schedule 2 of the Act.

Please keep in mind, if the death is due to a heart attack while on duty or while commuting to the office or going home due to stress and strain, the dependents will also be entitled to claim dependent benefits apart from the funeral benefit.

As I already told, that depends on the fact whether he died due to employment injury or not. Further, as of now, the maximum Funeral benefit entitled to any Insured Person/woman is only Rs.5,000.
