Resignation Without Notice In Probation

Hi All,
I am working for an IT company for 3 months. I am on probation of 6 months but I want to leave the company. They promised me for trainings on new technologies and very good quality of work but neither they provide any training or good quality of work. I am working on a project which is not related to my profile. When I talk to them on this matter, they said you have to wait.
Now I can’t work there and I haven't any patience to give them notice period of 2 months or salary in the lieu which is written in offer letter. I don't need any relieving letter from them. So I just want to ask if I leave the company without any notice period, Can they sue me.

Yes, if written in contract they can sue you, most company's don't but than legally Yes they have the right to recover the notice period or pay in lieu as the contract between you and them says so.

But I hadn't sign any legal contract.... they were just some normal piece of papers and there was also nothing written like sueing....

Mostly appointment letters have separate clause for resignation during probation period. Most companies mention that if an employee leaves during his probation period he has to serve a notice of 15 days.
Two month notice period will be valid for those who have been confirmed during the service. Kindly read your appointment letter and if it is mentioned that you have to serve a period of two months if you resign during your probation period then you have to, otherwise company has the right to deduct your notice period.
Even though it isn't a legal contract but when you sign the appointment or offer letter, it clearly reflects the mutual understanding between you & your employer. If you are not serving the notice period and neither allowing the company to deduct your salary, company reserves the right to move legally using this document.

But isn't there any employee rights??? What if the are giving you the work which is not of your profile, what if working conditions are poor, what if they never give salaries on time???
What an employee can do??

Explaining what all you have said your e-mail, you can send a detailed letter to them and request them to waive the notice period. This will be a better choice.You are giving them an opportunity to understand the situation.

I don't want to leave the company. The problem is that I can't work there because of the problems I am facing. I get rid of writing mails for each of my problems and what irritates when they don't reply. They just said you have to wait. I am already waiting for 3 months but nothing happened. So no option left to leave the company.

IT companies usually have a policy of selecting employees on bench, in the sense selecting employees for expected future projects or to help attrition related re-employment.

During this period they would necessarily not allocate the project of your choice or the project that would increase your knowledge, they would generally give you work wherein you are expected to help the company with their side projects, please understand you are being monitored & they also will test your patience level during this phase.

Once there is a live project, based on your current performance you will be selected for that project as trainee with other Sr. team members. Based on this performance they would decided your projects & growth path in the organization.

If clarity is the only problem you are facing, I think you should stick around & build in good rapport with seniors so that you can keep updating knowledge about company strategies and will then not feel left out or ignored. You can currently study codes of previous projects & increase your learnings.

If you have any further problems than you can think of leaving the organization.
