Struggling to Get My Relieving Letter: How Can I Resolve This Career Roadblock?

I worked as Sr. software engineer for some XXXX company in Chennai. Due to some personal reasons I resigned to the company after discussing with my managers. In discussion I explained them about my problem and I told that I need leaves in notice period. My plan was I want to go back to the company after some time. If I fail to go back and work with them I want to get relieving letter. So I explained my plan to the manager. After discussions they agreed for my requests

But unfortunately I was not able to go back to the services due to some personal situations. I got offer from a company before joining I went to my previous concern and requested them for relieving letter. They told me that they will send relieving letter by courier after some time. But they didn't send me. Again I went to HR manager and asked for relieving letter he told me told me that you were absconds from services. I surprised for his reply. Even I sent resignation letter and I stayed 45 days of notice period. Even I told them I am ready to clear if I have any dues.

After this I tried many times to contact them through mail and phone but they are not at all responding. What should I do now?

Please give me your suggestions. Your suggestions will save my career...

Did you serve the company for 45 days prior to the leaves you have taken, or is it including the leaves?

Hi Ravi,

I would say the problem is from both ends, 50/50, because you cannot blame the company totally for not relieving you since they have accepted your relieving, provided you would serve the notice period. However, from your side, you couldn't meet the requirements of the notice period. They cannot abscond you for this reason, but at least you can ask them to give you a chance to solve this issue without resorting to an absconding letter.

I am trying to contact them many times but still they are not replying to me. I was really not intentionally come out from the company because I really love to work there. Just because of my personal problems only I came out. Even if they say anything, when I went back to them I may stay with them. I am really worrying a lot. If there is any other way please let me know.
I really don't want to blame the company because they are really very nice people except in this case their co-operation was excellent when I was working with them.

If you intend to rejoin the company, why don't you seek help from your peers who previously worked with you and ask them to communicate your concerns to the HR department? Hopefully, they will understand your situation better and assist you accordingly.

Now I cannot go back and work with them because I have some personal problems, so I cannot relocate there. Otherwise, I really don't have any issues to work with them.

This is case of irresponsibility, unprofessional approach and indiscipline on your part.
Has your resignation been accepted by your manager or HR manager?
What I understand from your posting is that you took leaves during your notice period...you joined somewhere...and now you want your previous company to give you the relieving letter. This is ridicules and unprofessional.
Be it any company, they will do the same thing as is done by your company.
Yes, if you have Resignation Acceptance Copy, then you are safe to a large extent.
Try to take the help of those people who were close to you in the organization; your team members and your reporting manager.

I want to tell you one thing. I explained to them about my problem. I have taken 7-8 leaves during the 45 days of the notice period. After that, I was at my native place for 1 month due to personal problems. In the meantime, I tried for a job near my native place. Before joining the company, I went to the office, informed them that I cannot come back, and asked for a relieving letter. They told me there are no issues in giving a relieving letter. After that, I joined the new organization. I went many times to the previous company for the relieving letter, but they told me they are yet to make a decision. If they had informed me earlier, saying, "You have taken leaves, so we cannot relieve you," then I would have continued my services there. But after joining the new company, they are behaving like this. How fair is it?

I am telling you, I loved working there. I didn't leave for any advantage; it was just due to some personal situations only.

I am working for Deloitte in a process called EBOS. Recently, they sold it to Hinduja Global Solutions (HGS). We were given a resignation memorandum which had no severance pay and also offer letters from HGS. I signed them both on 27/09/2012. On the same day, HGS took signatures on joining formalities from us, including everything like PF forms, etc. People who declined had their last serving day with Deloitte on 05/10/2012. HGS employment starts from 08/10/2012.

I found out on 05/10/2012 that people who refused employment with HGS all received severance pay, even though it was not promised. I only accepted HGS's offer as I needed some sort of income until I found a new job. Deloitte falsely got me to sign it without announcing the severance pay earlier. I sent a declination of the offer of HGS email to my manager on 05/10/2012, much before their joining date of 08/10/2012, and also asked him to make Deloitte pay me severance as I am declining HGS's offer. Now, HGS says I should pay them 2 months of basic in lieu of the notice period. I have not even started with the firm. Also, Deloitte is refusing to pay the severance and give me a relieving letter, even after I signed the resignation memorandum.

Please help me in this regard and also recommend a labor lawyer who would assist me. I cannot afford high lawyer fees. I worked here for peanuts for 3 years and 9 months, and I also have PF to lose if this continues.

At the time of resigning, I informed my employer that I was resigning from my position without giving a 30-day notice due to my higher education exam. He asked me to hand over all my responsibilities, work, and company belongings such as computers, files, records, documents, etc., to the Manager. I handed over everything that was in my custody to the Manager, and upon his confirmation, I left the job.

After one year, upon completing my education, I interviewed with an MNC. During the interview, they inquired about my experience, and I mentioned that I had 1 year of experience with my previous company. They requested a relieving letter, which I was unable to provide at that time. The new organization has given me a week to obtain the relieving letter.

I have tried contacting my previous employer numerous times via phone and email, but they are not responding to me. Without the relieving letter, I am facing difficulties in joining the new organization. How can I obtain the relieving letter?
