Is It Fair to Pay 3200 Rs for 12+ Hour Shifts Without Any Days Off? Seeking Your Views

Dear Seniors,

If the worker gets 3200/- Rs per month as wages, is it fine? Provided 12+ hours of duty, 365 days working, no holidays. Kindly give me your views. I personally feel that management is offering them a lesser amount.

Your worker is getting 3200/-. Do you have an option for extra hours pay in your company? If it is available, you can motivate them in that manner. After that, you can inform them by proposing the performance appraisal based on your company's policies. If they are performing well, there will automatically be a hike after 6 months or 1 year.

To decide whether the salary of Rs. 3200/- paid to an employee is correct or not, you need to study how much is paid in the similar industry in the same region, in the same conditions. You also need to check that the conditions you have mentioned are not violating the Statutory Rules & Regulations such as the Factory Act, etc.

In my opinion, nobody will be able to tell you what the right wages payable are unless and until he/she personally sees all the facts, as the details you have mentioned are not sufficient to give an opinion.

First, determine if your company is covered under the Factories Act. If yes, then the salary should be no less than the minimum wage, and according to the Factory Act, you cannot work more than a 10-hour shift. Please take a look at it.

Does your company belong to the steel manufacturing industry? Working 12 hours per day is not permissible for the entire month. First, check the minimum wages implemented in your state for your industry. If it is found to be suitable, then it is okay. If not, please talk to your management.

Ensure that your company workers are not working 12 hours on a daily basis.

The condition that you mentioned here, I think it is not in existence because it's simply harassment of the workers in the present scenario where wages are inflating, and with 12 hours a day, they are getting nothing. If it really exists, then there might be chances of disputes related to wages, and the trade union might enter the picture; it's simply exploitation. If it is still present, then there is one solution. You should study the job analysis of work, the risk, the workload, duration of hours, and with that, you can evaluate each job and fix appropriate wages or salary.

Please refer to the Minimum Wages Act and Factories Act in your region. A wage of 3200/- is very low, and the working hours are excessive; this is not permitted by any labor law. Otherwise, the employer should pay overtime as specified in the Factory Act.

Additionally, please note that a weekly day off is mandatory after six continuous working days in a week.

Please refer to the Factories Act, 1948, Chapter VI for the working hours for adults, which is 48 hours per week. Any hours worked beyond this limit should be compensated by paying overtime.
