Can You Nominate an Uncle for PF Pension? Understanding Legal Dependents in Form 2

Could anyone tell me if an employee can nominate his/her uncle in the PF form 2's pension scheme? Who are all called as legal dependents for this purpose?

I have just listed below the FAQs regarding nomination under the Family Pension scheme, taken from the official website of EPFO, Chennai.

1) Is the employee the only beneficiary of the Fund?

Benefit will be paid to him/her and in his/her absence to his/her family.

2) What is meant by Family?

Family means employees' spouse and children below 25 years of age.

3) Suppose the employee does not have a Family and he/she dies before receiving the benefit. Does his/her pension get lost?

No, if he/she does not have a family, benefits will be paid to his/her nominee, who will receive the benefit in his/her absence.

4) Suppose a member has not nominated anyone?

The amount will be paid to the dependent father or dependent mother as the case may be.

5) Can a member change his/her nomination?

He/She can change his/her nomination whenever he/she decides within the framework of rules for such nomination. In other words, if he/she has a family, the nomination should be in favor of a member(s) of the family. If he/she has no family, he/she can nominate anyone he/she wishes.

If none of the parents of the employee are alive, nor does he have a family (family - wife in case of a male member, husband in case of a female member, son & daughter), in that case, he can nominate his uncle. However, his uncle will cease to be the nominee once he marries.

An employee died last month without making any nominations. Will I need to deposit Form 20D and Form 5IF for her husband and two sons separately, as well as Form 10D for her husband? Please advise me on the required forms urgently.
