Understanding Fixed Term Contracts: Legal Insights and Industry Practices Needed

Hiten Parekh
Dear Members,

Can you please provide me with the legality of 'Fixed Term Contractual Employment', general pros and cons, case laws, guidelines for its execution, practices by industries, and any related information you feel is relevant. I have read about it in the Standing Orders Act, Schedule I - 2 (h). Is there any mention of it in the Industrial Disputes Act?

There are two kinds of fixed-term contractual employment:
1. Directly employed by the establishment as a temporary employee or contractual employee for a fixed term.
2. Fixed-term contractual employees employed through a contractor (Contract Labour).
In the case of the second, there is a specific Act to regulate the services of contract labor known as the Contract Labour (Regulation & Abolition) Act 1970. Those who are directly employed in the establishment through fixed-term agreements have the same negative effect and can claim permanency. They will be covered by the Model Standing Order Act. So, about what kind of specific fixed-term employment do you want to know?

Please provide further information and practices.

Thank you for your response, Mr. Rajesh! I am an HR professional working for a manufacturing firm. I would like to study the system/features of the arrangement and, if feasible, introduce them in the organization I am working for.
