The Ministry of Labour has issued a notification giving effect to all the amendments to the ESI Act vide ESI (Amendment) Act 2010, with effect from 1st June 2010.

1. Persons loading and unloading goods, whose activities are controlled by their employer, are covered. (Jain Plaster and Minerals - 2002 (94) FLR. 533; 2002 (3) LLJ. 141)

2. Mutha coolies available on the spot for loading and unloading ARE NOT TO BE COVERED. (Supreme Court - ESIC v. Premier Clay Products)

3. Hamalies/coolies/labourers who come with the transporter (lorries etc.) for loading or unloading in the premises of the factory are not covered. (Bombay High Court - Rai Sahib Tekchand Mohate Mills vs. ESIC)
