Factory Act And Its Applicability

Sirs,
Would like to know whether the Factory Act becomes applicable from the day the drawings/plans are submitted with the Factory Inspectorate office or from the day the manufacturing activity is started.
Secondly if the manufacturing activity is not started and the other conditions i.e use of power (DG Sets) and more than 20 employees have been engaged will the Factory Act become applicable.
Request all seniors to share their views on this as the same is urgent.

Dear anand,
the premises u occupy will not become factory unless u start manufacturing process therein . sending building plans for approval and using power for the purpose other than manufacturing process will not make any difference. sec. 7 of factories act casts an obligation on occupier of the factory to send anotice to chief inspector of factories 15 days before u intend to start manufacturing process. this is is called obtaing factory licence. before that provisions of act are not applicable.u r welcome to ask if issue is noyt clear.

Dear Mr.A.Kaushik,
The details provided by you are very valid & helpful. Could you also inform whether just by establishing a small chemical testing laboratory in your business premises for conducting tests on the chemical products being procured and sold by a firm for their trading business tantamount's to running a factory in the business premises. We are being harassed by Government Department in Mumbai for not having a factory license for our firm. Please help.

(k) “manufacturing process” means any process for—
(i) making, altering, repairing, ornamenting, finishing, packing, oiling, washing, cleaning, breaking up, demolishing, or otherwise treating or adapting any article or substance with a view to its use, sale, transport, delivery or disposal or
5[(ii) pumping oil, water, sewage or any other substance; or];
(iii) generating, transforming or transmitting power; or
6[(iv) composing types for printing, printing by letterpress, lithography, photogravure or other similar process or book binding;] 7[or]
(v) constructing, reconstructing, repairing, refitting, finishing or break¬ing up ships or vessels; 7[or]
this is the definition of manufacturing process as per factories act.. please refer to second point , point (i) otherwise treating or adapting any article or substance with a view to its use, sale, transport, delivery or disposal, in this treating of chemicals fall, so its a factory and u need to get a factory license
