Facing Legal Risks with Fake Certificates: Can I Avoid Trouble in a New Job?

I am Mr. X, who completed my degree (still 12 arrears pending) but managed to get placed at a leading MNC during my studies. After completing the course, I worked at that MNC for 1 year. Upon joining, I provided only copies of my original marksheets and did not produce the provisional certificate. They did not inquire, and everything was going well for the first year. However, after a year, they requested a copy of the provisional certificate, which led me to fear the situation, and I decided to resign.

Currently, I have a 1-year experience certificate, but not the original degree certificate. Now, coming to the point, I am considering joining another MNC with a fake edited copy of the provisional certificate and marksheets (although I completed my studies, I intend to change the failed subjects to pass) while providing the correct experience certificate.

I am concerned about the possible consequences. Will I be caught during the background check? I am prepared for the outcome but wish to understand if there is a risk of arrest or legal action.

Is there a chance that I could avoid detection and continue working at the new company?

My main fear is facing legal consequences. I am not worried about receiving a termination letter but fear arrest or legal issues. HR professionals, please assist me in this situation.

Is there a clause present in your appointment letter or employee handbook? If so, your future will totally depend on management decisions. By the way, it is a criminal offense, and you will be booked under ACT 420.

Forging documents is a criminal offense. If the company wants, they may take action against you, or in most cases, fire you.

I request that you do not ask for unethical advice in this forum. This forum is for the sharing of knowledge, views, and ideas.

I believe you should focus on giving your exams and trying to pass rather than resorting to such practices. Once you engage in unethical tasks, you will always live in fear of being caught.

I would like to know what should be done if an individual submits all their original academic and professional degrees, along with relieving letters from their previous company and salary slips, to a new company. If the new company discovers that professional degrees such as an MBA, B.Tech, or MCA are fake, or some of the mark sheets are incorrect based on university records, what action should the company take?

There is one more condition in my company. One person is working as a Senior HR Executive. His qualification is an MBA in HR with 65%, but he did not complete the course himself; he obtained the degree through payment. Is there any action I can take against him? Please advise.

First and foremost, an employee joining a company needs to be honest. Instead of living in fear, sooner or later, you are bound to be caught. This experience can be highly humiliating if you falsify experience and qualifications. It is crucial to remember that being dishonest can lead to being trapped by your own lies. If you are caught in such deceit and then join a new company where a background check is conducted, it will reflect negatively on you and could impact your future prospects.

It is far better to disclose the truth to your new employer and set things straight from the beginning. There is nothing wrong with being transparent about your background when starting a new job. This way, you can have peace of mind and fully focus on your work.
