How Can I Claim My Unpaid Dues After Resigning from My Previous Job?

Dear all,

I had tendered my resignation from a private limited company in December 2009 with a notice period of one month. I obtained clearance from them in January 2010 and subsequently joined a competing company. However, my previous company has not yet cleared my dues.

I would appreciate guidance on how to go about claiming my outstanding dues.

I had given my resignation from one of the Pvt. Ltd. companies in December 2009 with a notice period of one month and taken clearance from them. After that, in January 2010, I joined a competitor company. Now, the company is not clearing my dues and is saying that I signed a bond which prohibits me from joining any competitor. However, the bond's validity was for two years, which I have already fulfilled.

Therefore, I kindly request all of you to please let me know if there will be any issue with receiving my dues or if any legal action can be taken against me.

I would like to request you to go through the contents of the bond if you have a copy. Kindly check if the clause mentions that you cannot join a competitor's company within two years of leaving the services of the first company. If the clause does state so, then the company may be seeking shelter under that provision. However, such bonds are not legally enforceable unless the previous company has incurred expenses on training you abroad to acquire specific skills. Otherwise, these bonds do not hold any validity.

You may consider issuing a simple legal notice for the prompt settlement of your dues through a lawyer. Subsequently, based on the same, you may proceed with legal action as necessary.
