Maternity Leave Confusion: Are Paid Holidays and Sundays Included?

Hi All,

Can anyone help me in getting clarification about maternity leave? I want to know whether an employee availing maternity leave is eligible for paid holidays and Sundays falling during the time of maternity leave.

Salary or payment to an employee for the maternity leave period will be inclusive of holidays and off days falling within the said period. In other words, if an employee is availing maternity leave from 1st August, she will be getting full salary for the month of August as if she had worked for all the 31 days without considering a public/national holiday (15th August) and four Sundays (off days).

Thank you for the reply. It is definitely helpful information for me. However, I further need clarification on that. If I consider the above-mentioned case as of August, do we have to allocate 26 days or 31 days for maternity leave? My query pertains to whether Sundays and paid holidays should be considered as regular holidays or if maternity leave should be accounted for on Sundays and paid holidays.

My parent company in the US offers paternity leave, but there is no law in India to support this form of equal rights. Do companies support this kind of leave?

In fact, progressive companies have also started giving paid leave (maternal as well as paternal) in case of legal adoption of a child. The quantum of leave varies from company to company. This is to help the family and the child settle well and bond together. It is also considered as their contribution to CSR.

Dear All, I would like to know more about the Maternity Act Benefit in the case of surrogacy and also in the case of in-vitro fertilization. Do these two scenarios have the same consideration in the law as far as benefits are concerned? Will the mother be eligible for the same benefits in the case of the above two scenarios? Looking forward to your responses.
