Is It Legal for My Company to Offer Only Paid Leave Without Casual or Sick Days?

Please suggest: In my company, there are no Casual Leave or Sick leave benefits. Only 16 days of Paid Leave (PL) are provided. Is this legal? I would also like to confirm the regulations regarding this matter. If Casual Leave/Sick Leave is mandatory, how many days should be granted? Your urgent assistance is greatly appreciated.

If your company is registered under the Factories Act, all the workmen are eligible for earned leave at a rate of 1 day for every 20 working days. This leave must be credited in January every year (a workman will receive a maximum of 16 days of earned leave in a year).

If your employees are covered under ESI, you are not required to provide any Sick Leave. However, if they are not covered under ESI, a maximum of 6 days of Sick Leave can be granted, and this is mandatory.

The granting of Casual Leave is a management decision, and this can be provided for a calendar year ranging from 6 to 12 days. As for management staff, you have the flexibility to decide on the leave policy.
