Has the ESI Amendment for Trainees and Apprentices Been Officially Notified Yet?

Recently, the Parliament has passed the bill to amend the ESI Act. This amendment removes the exemption of coverage of ESI for Trainees and Apprentices under the Standing Orders of a Company. Can anyone inform whether this Amendment to the Act has been notified in the Gazette of the Government of India? If so, what is the date of effect?

Hi! After the amendment, the clause reads as follows:

"" or any person engaged as an apprentice, not being an apprentice engaged under the Apprentice Act, 1961 (52 of 1961) and includes such a person engaged as an apprentice whose training period is extended to any length of time."

This amendment, though passed by both houses of Parliament, notification is yet to be issued to give effect to it. Once this comes into force, the trainees engaged under the standing orders of the establishment also stand covered.

Notification has been issued by the Ministry of Labour, giving effect to the amendments with effect from the 1st day of June 2010. The notification is available at http://labour.gov.in.
