Dear Seniors,

Please advise whether a HIGH COURT ruling/judgment order is applicable across the country. Kindly support your input with an example for better understanding.

Please try to clarify what exactly you want to know. The High Court verdict is not a rule of the central government, or to be more precise, a law of the Indian Republic. What is the case? What is the verdict? Is it related to a government policy, rule, or practice? Is it just involving two parties where one is the government and the other is an individual? Once you clarify this, maybe we will be able to provide some answers.

Kind regards,

High Court ruling/judgement orders are just for reference. If any new case looks similar in nature, it is expected that a similar judgment will be available if tried in court.

Well, this is regarding the latest judgement of the Division Bench of the Karnataka High Court in Group 4 Securitas Guarding Ltd Vs RPFC (2004-II-LLJ-1142-Kar H.C).

Your view is awaited.

Thanks in advance.

Hi, it is not applicable throughout India, nor is it a landmark judgment. However, this can be used as a supplementary citation in other similar cases by the parties. In this PF case, the court has not nullified any section of the act/rules nor validated anything new. Hence, it is not a rule.

Kind regards,
Dayanand
